partition to daughter

Am anusha..my marriage is love arranged as my father did our marriage ..on April 17..thn later without telling us my father stooped giving college fees and started fighting with us..then I sent notice to my father asking share in property of him.(that property given my grand father not owned by my father) now recently he sold property to others without giving answer to me..so what should I do now can any one help me with your answers

YOU FILE A SUIT AGAINST YOUR FATHER AND BUYER FOR CANCELLATION OF THE SALE DEED AND RESTORING HIS PROPERTY IN WHICH YOU HAVE A SHARE.ONCE THE SALE DEED IS CANCELLED AND YOUR FATHER RETURNS THE CONSIDERATION TO THE BUYER OF YOUR PROPERTY YOU CAN FILE A PARTITION SUIT.

but my lawyer is telling we cannot send notice against sold property ..only we can ask share in that property .so what should I do next

Consult A Local Good Senior Advocate with all evidences and Serve a Notice to the Buyer also Mentioning/Justifying your Rights Legally and make a News Paper advt also Regarding this .Mostly there could be a Compromise Or File a Suit against your Father and the Buyer.This is Legal Advise.Better Sort it out with your father On Saying Please.It my Suggestion.

It is believed that you are Hindu, and the property in the hands of your father was not ancestral.

Grandchild has no forced share in self acquired property of grandfather.


If it was self acquired property of your grandfather and your father inherited it then it should be self acquired in the hands of your father.


Your father could dispose it by a valid/registered deed in his life time.


You can try by litigation or by being sincere, affectionate, to your father.


It is your choice.

You still can take a legal action against the transaction made towards the ancestral property.. You need a good lawyer to proceed.

Property is sold completely by my father last month..NW can I ask share by sending notice to both parties..

whether ancestral or self acquired, when the holder of property (father is alive) he has every right to dispose the property. as a daughter by birth you cannot claim it a matter of right.

Some experts are in the habit of posting cheap comment on experts. They should not take pain to send message for feeling sorry and regret to me at least.
