Original suit - civil

(Querist) 30 August 2019 This query is : Resolved 
Hello Sir,

Original suit filed @ District and Sessions Court, Hyderabad and case is pending since 14-03-2019, its been 5 months now and we have not granted Injection order temporary or permanent. Case status still shows at summons. Please suggest what to be done to get Immediate Injection or some sort of relief to stop illegal possession/construction from respondents.

Case History: We petitioner are legal heirs of said property which belongs to our Grand Father/ Father, respondents have created a illegal decree with fake signatures of our ancestors, now legal heirs of respondents have made development agreement with builder.

Appreciate expert advice and inputs of above case to get Injection order ASAP

If your advocate is not able to proceed with the matter you can change him at any time. And as you have already appointed advocate so follow his advice or you will be confused with other's advice.

Generally the court will not issue injunction order without summoning the defendants and obtaining heir response to your application for interim injunction, unless you satisfy the court of the extraordinary circumstances for grant of injunction pending service of the summons.

In an ad-interim injunction application the Court shall proceed expeditiously, if not ex-parte. Your statement is incorrect or facts differ from what you have posted.
What is the opinion and advise of the lawyer engaged by you with respect to your question?
If you have lost faith in your lawyer change him/her immediately.
It would be better to consult another local prudent lawyer for appreciation of facts, guidance and proceeding .
