need infor mation regarding sale

we are 5 heirs of our joint ancestal property andout of which 3 have signed a saleagreement and they have taken cheques on our behalf iam not interested in selling the property .will the sale happen without my sign and i am ready to pay back the advance given on my shareand the agreement period is also over now how to proceed

Send a legal notice or letter by RPAD informing the heirs that sale deed cannot be executed as the agreement period is over.

Attach along with the notice the demand draft for the amount earlier received by you as consideration towards the sale agreement.

(Please note that there are chances that the other heirs may not agree for you to cancel the agreement and they may file a specific performance suit against you if you cancel the agreement)

The best option is to publish your intention of not alienating the property in the local newspapers to all prospective buyers and at the same time raise objection before the intended buyer that you are not interested in selling your share in the property. Apply to the court for partition of the disputed property.

was the agreement to sale was registered?If yuo have undivded share in the propery ur brothers also cannot sale the the same. If at all they regester the sale agreement for their share apply to revenue authorities for not entering the purchasers names in ROR.contact the purchaser and tell him the truth orally or in written that i m goning to raise objection in ROR. get partitioned first.regarding ur agreement call 9422773303
