My advocate presence in 498a

Respected Experts , After my dowry demand compliant against my husband and inlaws , FIR got registered thru Mahila Thana (Women Police Station) . Now my husband got bail after he surrendered ( while his AB was rejected by session court) . Police has put the file in the court and on every date my husband is appearing along with his adocate for charge framing . My advocate is saying that myself will be summoned to appear in the court after the charge framing is done. As of now neither me nor my advocate is appearing in the case of 498a. Now my query is 1) will it not effect on the case that niether me nor my advocate is appearing on the hearing date of this case. 2) how much normal time court is taking to frame the charge ?

Mr. VR shrroff . U are one of the senior lawyer and it do not suit to ur personality to comment without knowing the facts. according to you what shud I do to get the justice for me and my one year minor son . I was 6 months pregenent when I thrown out from my matrimonial home. on born of my son we sent them massage but they did not turned up till now. For last 1.5 year I have not seen my elder son to whom they have kept forcefully. Can u understand the pain of mother who has not seen his son for 1.5 years. You people has create this forum to help people on legal , not to give pain by giving this type of wording . Please do not answer instead of giving painful wordings.

If u want your 1.5 years old son, Law says tender aged baby custody with mother only.
The moment you file civil case in DC,under GW Act sec 7,8,9, or FC sec 7g, you will get custody of minor son and access immediately.
Dig where u get water, Digging stone will pain you.
My earlier reply for general woman in India. They use DV, 125, 498A, gwsec 18, sec 24 HMA, just o increase their Bargaining power, to get more money.
I hate it as it ceertainly break home.
All Ego should vanish, Surrender, and see the pleasure after short duration pain. Life becomes wonderful.
Replace hate and revenge by Love.
As u rightly said ur sepn at 6th month of pregnancy. It is Psychological change of behaviours, whereby you neglect husband/s need to take care of coming child, and majority of separations for Divorce start between 6-15 months of conceiving child.
All Mat disputes are cause of misunderstanding & Ego. Avoid it , and in fact all humans are wonderful. Nobody, either wife or husband are bad or cruel.. Thinking make it so.

Learned expert Mr.Shroff has beautifully explained the after effects of 498a, there is nothing wrong in his observation, infact it will be very useful to hint those who are bent upon to initiate action against their husbands/in laws in the name of taking revenge on them. Thus do not be offended if you feel that you are not one among them to be blamed.
Now to your query; since 498a case is a complaint before police and it is a state prosecuted case, neither you nor your advocate need to be present in the court for observing the proceedings regularly. You will be summoned to the court for deposing your evidence and for cross examination only. It will not affect the case in any manner.
The time cannot be predicted that how long will the court take to dispose the case.
