Misuse of 498a : my wife put several false allegation on me. need help

Guest (Querist) 03 April 2013 This query is : Resolved
My wife filed an FIR blaming me with
498A / 323 / 504 / 506 IPC & 3/4 DP Act.
Just after I filled a case for divorce because my wife had done adultery with my boss.
All allegations are fake.
After I filed my case in family court I filed an NCR that my wife can plan such things. And she did.
Please help me and guide me.

have you taken bail
Devajyoti Barman (Expert) 03 April 2013
Since case has been nothing could be done.
Get your bail preferably anticipatory bail soon and fight the case on merit.
Only trial could establish whether the case is false or true.

Get A.B. and contest that is the only way out.
I shall not surprise if one day i hear
the social greatest marriage institution has 'fallen through' because of these marriage laws.

Thank you for you help.
Guest (Querist) 03 April 2013
Thank you i will rush for anticipatory bail.
I have one thing that can prove this case false.
Once i had a chat with my wife asking have any of our family ever threatened you, or ever tortured you or even asked for dowry? she said no never your family is the place where i found love. she also accepted that her father asked my parents for 6 lacs rupees but my parents didnt gave any thing and i had captured her conversation in my handycam. it can be used in this case?
To safe gaurd me.
One more thing right now my case is in mediation.

The evidence in the handycam is duly admissible in the such litigation so use it perfectly.

He being a student, the query seems to pertain to his class-room exercise.

Just now, after my previous post, the querist got his member account deleted to conceal his identity as a student.

is it? we not reply academic query.
Guest (Expert) 06 April 2013
Yes, before I started typing my reply, his name was appearing and his profile indicated him as a student. But, after reply appeared his account was found to be deleted, as in one of his earlier query also I pinpointed about his hypothetical query merely on his presumption basis where he stated that "IF HIS WIFE CLAIMS MAINTENANCE, what should he do, as that appears on the following link:

Admin should develop a mechanism vide which such repeated queries may not appear on board so that the valuable time of the experts may be saved. It shall ultimately make them devote their maximum time to the actual needy persons.
prabhakar singh (Expert) 06 April 2013
I do agree with Mr.Makkad.
