I got married on 21. 06. 2009. i am working in construction company before marriage. my job is the frequently movement of various project as per company demand. i am oldest son of my family and my family depended on me. without any reason she refused to stay with my parents, which is matrimonial house. she started false allegation, abusive word and threatening to me and my parents with her other family members also. she asked to stay with me on job location. i agreed any how but this will not possible every time, due to sometimes i have to work in remove area. actually she want all my money with her and donot want to share with my family members. she and her family members started threatening to file 498. what we have to do for safe guard.

you can also file same section in ipc 498a with above said allegation to your wife, you first file a case otherwise you will lose preference

I differ from expert a married man cann't file a case in 498a ipc it is the safeguard only provided for married women

No, you can not file 498a.
Be in touch with local SIFF members, become a member of www.498a.org and contact some good lawyer in her area.

Dear Sirs,
Continuation of my earlier mail,i will be highly obliged if some one suggesting me good plan for safe guard for me and my family. i know that my wife and their family members planning to file 498 against me and my parents. we have given a solution to them for agreement between infornt of lawyers, but they are in confusion, saying that my wish and demand will not be considered. in that case probably she will go for file 498, which has already told to me.

if she lodge a fake complaint mean you can break it..
right now where is she? if she is staying from her paternal house mean just file a rcr petition and call your wife to restitution conjugal rights.,

There is no foolproof arrangement to make other to take recourse of legal machinery except persuading to settle the matter amicably which you are already trying. You should expedite your efforts with the help of some mutually respected middle man or Panchayat.

Mr. Makkad's advice is worth considering. In case of necessity these mediators will be of help in giving evidence before the court if your wife files a complaint.
