My inherited property( A house) is in name of me n my sister. She is a patient of cretinism (Hormonal imbalance) . She is married twice (after divorce) Now her inlaws want to annexe the property. She has given me an irrevocable power of attorney. Can I transfer her share to my name or to my wife's name so that i can guard this property from getting annexed. Also i ve been taking care of the property and putting in my money to keep it in shape.

relations between brother and sister are based on trust . your sister has given you an irrevocable power of attorney .
please take your sister into confidence before taking any decision .
if you transfer property in your namewithout her consent you will ruin your relations . on basis Of power of attorney you can sell tthe property . under no circumstances transfer it in name of your wife . that would not be appreciated ever by your sister

What purpose she given u irrevokable PA. Even it was given for u for some personal reason , if need , then. Transfer to ur wife name

any property worth of more than Rs. 100/- transferred by any mode such document requires compulsory registration.

Irrevocable power of attorney MUST BE REGISTERED AND MUST HAVE CONFERRED RIGHT TO TRANSFER ONLY THEN YOU CAN LEGALLY ACT IMMORALLY AND STILL IT WOULD BE OPEN TO CHALLENGE BY YOUR SISTER AS YOU STATE She is a patient of cretinism (Hormonal imbalance) and that includes mental deficiency too.

I stand with the opinion of sethi. It shall be good for you to take your sister in confidence prior to proposed action. You cannot get it transferred in your name but in the name of your sister.
