leave encashment on compulsory retirement

(Querist) 09 October 2015 This query is : Resolved
Dear sir
I b a has allowed leave encashment on compulsory retirement. The effective date is from date of circular.does it mean that employees compulsorily retired after date of circular are eligible to claim encashment or it means that an employ compulsorily retired earlier may claim encashment on or after issue of circular

The language and statement in said circular may carefully be gone thru.

Generically speaking: it might be employees compulsorily retired on or after date of circular.

You may show the said circular to bank employee's union leaders and your counsels.

ho is employer?

It appears you are a Bank employee. The advice of IBA to its members to restore encashment of leave with effective date is wrong and can be contested in a Court of law. Come with full facts. I will guide you to the extent possible.

It would be applicable after the date of the circular, however full language need to be referred, consult your association office bearers.
Dr J C Vashista (Expert) 10 October 2015
Show the circular to association persons and/or a local lawyer for proper analysing and guidance.

Language of the circular matters much. Get the circular examined by some expert.

I agree with the advice of Sri Vashista and Sri Dhingra.
