My advocate has become very pally with the advocate of the opposite party and seems to have given up on my case just when we were on a stronger platform he has started absenting himself from court hearings also.. I suspect he has been harnessed in cash & kind. How can I get him back / or force him to be honest. He is good in his work.Should I look for someone else ? Is there no work ethics , how can I force him to be loyal? Please help. I am worried.

Dear Kalyani

If you have lost faith in your counsel, then it is always better to hire a new one, however, good he may be in his area of specialization. There is a old saying that you can force a horse to the water but cannot force to make it drink the water, there is no force which you can exert to make him honest. There are ethics but alas ethics are only preached not practised. Therefore the less talked is more better. Change your lawyer immediately before any considerable damage occurs to your case.

Practical process: Take his consent to engage an other advocate and Request him to remain sleeping in your case.
Legal/bookis process: File an application before court for grant of leave to terminate your lawyer.

Better to change ur lawyerwhen u have lost faith on him. U have to take the no objection from the lawyer on the vakalat to appoint the new advocate. If your advocate din't give you no objection then u will have to issue notice to him regarding withdrawal of his valkalt.

Without going into your allegations, once you lose confidence on your lawyer, the best way is to engage a new counsel.

As every body sujjested faith on your Advocate is most important. Once that has gone engage another Advocate. You can ask for relinguishment letter from him to engage another Advocate. If he refuse to give it don't worry the concerned Court can permit you to engage another Advocate of your choice.

Advocate - Client relationship is fully based on faith. If you have lost the faith on your lawyer, you should engage a new lawyer for your case.

Due to so many reasons some time client think that his advocate is not working well or he is no more faithful but the thinking is one sided. You just charge and pursue your advocate. keep yourself up date about your case and insist you lawyer that the on next date the work should be done for which case is fixed for. Do not think that your advocate is not loyal I think 90% advocates are loyal even today. If he is not loyal, the same position is with the next advocate you hire and so on. You will find not a single advocate faith full to you all over India.

You can just test him.
You send an unknown person with some money and offer him to loose your case for bribe. I think he will return back that person and it is ultimate test to check him.

Be confident on your advocate he is simply paying less attention on your file which happens.

I am also totally agree with Mr. J. K. Agrawal. U will find very less lawyers who sincerely pay attention to their clients. So, if u have time, then try to test your lawyer anyhow. Still u are not satisfied with his work, then definately u have to change your lawyer.

If u are working with someone, then u have to trust that person for his work & If u can't do that, Please change that person.
