I want to file a cheating in chief metropolitan magistrate

sir, I have filed a writ petition through advocate in high court which is pending and also respondent has not file his objections and its present status is adjoined now i want to file a cheating case against respondent . Since the matter is pending before the high court do i need permission in the high court or not if permission is required what is the thing i have to ask in the high court please suggest me i am a suffer of no fault of mine

always start filing case from lower court in your case i dont understand how can u file coplaint in high court under writ pettion. the proper remedy to file complaint to police then superior authority of police and then magistrate.

What writ has been sought in your petition from High Court?

Whether the subject matter of writ and cheating are different or same?

What is the opinion and advise of your lawyer, if it is a true story/query?

Why do you need second opinion for the story/query, if the story/query is true, except the fact that it is FREE OF COST on this platform? If you have lost faith in your lawyer change him/her immediately.

sir by the way of resolution government officials has registered my property for land to land scam for which i have file a WP through a advocate to quash the resolution now my Query is can i file a cheating case when the writ petition is still pending are can i beg in writ petition to initiate a cheating case along with to quash the wrong resolution

These are two different cause of action, you may proceed to file a case of cheating.

Discuss with your lawyer who is well equipped with all the facts and circumstances of the case(s) and competent enough to decide, guide and proceed.
