respected sir/madam
my friend(wife with a daughter 4 yrs old)filled a 125 maintenance case in tis hazari court delhi . almost 3 years going to complete only 3000 interim maintenance orderd for both with and daughter .
question 1) husband want his passport .my friend having his passport . in that passport husband is single , he didnt changed his status.Tell me sir , my friend surrender his passport in the court and what happen if he leave india??
HOW SHE BRING A WITNESS IF ALL THAT HAPPEN IN THE ROOM AND IN HER MATRIMONIAL HOUSE .
question 2 ) my friend lived with his friend only for 4 month. in that 4 month he tortured her in his room , beating her all the time and not giving food to eat and treat like her a maid. Tell me sir, how my friend proof all this happen to the court . beacuse her husband didnot allow her to go outside the house. How she proof all physical and mental torture before the court.

SHE FILED COMPLAINT CASE AGAINST CAW CELL NANAKPURA WHICH IS STILL PENDING . NO CHARGE SHEET FILLED . SECONDALY SHE FILED 125 CRPC MAINTEANCE CASE ONLY.
MY FRIEND DONT WANT ANY MONEY SHE WANTS TO SHOW THE REAL FACE OF HER HUSBAND . SHE DONT WANT TO GIVE HIM A DIVORCE ALSO . IF SHE WILL GIVE DIVORCE , HE WILL GET ANOTHER OPPORTUNITY TO WASTE MANY DECENT GIRLS LIKE ME.

1.If your friend admits that she has his passport with her then she will have to surrender it. Another option is to deny its possession.
2.Wife can not stop restrain her husband from leaving India to earn livelihood.
3. However in rare cases u/s 498A IPC the court can put restrictions on foreign travel.

She should discuss all facts in detail with the local lawyer.

I fully agree with the expert advise of Mr. Devajyoti Barman.
However as stated your friend got married, stayed with her husband for 4 months and she has 4 years old daughter, she had filed a complaint before CAW Cell Nanakpura alleging torture etc. for more dowry. FIR is yet to be registered but maintenance @ Rs. 3,000/-per month has been awarded by Court on your "friend's" application u/s 125 Cr PC; can you please tell how and why are you so perturbed/ disturbed/concerned and taking so much pain/interest with the circumstances and case(s) of your "friend"?
How can you or your friend stop or blackmail her husband (by stealing his passport) from visiting/working abroad and/or infringing his fundamental right?
Whether you/your friend have faith in her lawyer (who has filed her case u/s 125 Cr PC? If yes, what for do you want to have another opinion/advise except the fact it is FREE OF COST on this platform? Did you/your "friend" seek his/her opinion and advise?
If no, change him/her immediately.
Prima facie it is a concocted and academic query.
