how get NOC from advocate or alternative solutions to get NOC

My advocate has misused and diverted the case, so i don't trust him any more now i want to take NOC but he is not giving NOC and asking more money.

How should i deal with this kind of issue. Please suggest possible options to resolve issue.

1. can i discard this case and file a new case will court permit?

2. can i go to police to get help.

3. Any other method which should help to get NOC or i should be able to go to new advocate and run the case.

Please guide me.

You can file an application in the court revoking the vakalatnama of the advocate and seek permission to appoint another advocate. When the court grants permission, you can file vakalatnama of another advocate even without NOC from the previous one.

Yes, you could also lodge complain to the bar association also.

Yes. I agree with adv.archana.. You can send a private notice with acknowledgement card to his counsel for revoke his vakalathnama. Along with that notice, the new counsel may entered with your case.. All the best.

How do i get documents which are with advocate. Can i get a copy of documents from the court itself.

Without documents will it be possible to go to another advocate, what are the chances accepting case without documents.
