Hiba nama

(Querist) 29 December 2020 This query is : Resolved
We are 3 brothers and 1 sister and my mother has made hiba nama on me and second brother means my mothers land is distributed between two son ,
Futher by other brother and sister will have right on that land or no?
Quick Summary
This discussion clarifies the implications of a 'Hiba Nama' (gift deed) in Islamic inheritance. If a mother has legally transferred land to two sons via Hiba Nama and given them possession, other siblings generally have no further claim on that specific property. The validity of the Hiba Nama does not depend on registration or stamping for it to be legally binding once possession is transferred.

Advocate Bhartesh goyal (Expert) 29 December 2020
Hiba is not required to be registered and stamped.if your mother has transferred the property to you and your brother through hiba and delivered possession of property to you and your brother then your brother and sister can not legally claim over property.
Rajendra K Goyal (Expert) 29 December 2020
If the property given to you by HIBA, your brother and sister has no claim on the said property.
