if will has been made by your grandfather of his self acquired property in favour of your aunt apply for probate of will . probate is judicial proof of will being made . let them contest the will if they feel it is not made by your grandfather

mere issue of legal notice does not give them enttilement to 1/3 rd share .fifling of criminal case against your aunt wont help them if valid will has been made

Hey Ajay and Raj Kumar thanks a lot guys.

Well its a self Acquired Property only and everything is the name of Aunt as she is unmarried so everything is on her name so that she can live her life indipendently and we are also not claiming anything from her as there was some FD'S But we have given to her only.
Now we should wait for 30 days as her notice time will over and if she files a case so what should be our action and I guess only civil suit will be filled as criminal intentions is not required nor any intentions were shows though she only harasses her that she will come to India and sit in her home only.

Regards
K

i was not aware that this is a repeated query . please dont ask same queries again and again

primarily the suit is of civil nature, so better would be to follow the civil suit proceedings only.

in case the will is found to be forged then you may take a criminal action as well.

since you are a fresher, I would advise you seek help of some senior counsel in your matter.
