Gift deed

Dear Sirs

I am belonging of tamilnadu- I need your kind reply for my below query.

We are 3 sons in which both my elder brothers were given properties by my father under partition.

I am the younger born later also when i was minor one of my father property(came from ancester)which was given to my elder brother under gift settlement basis in the year of 1990- on that occasion i was minor.

Now father & one of my brother are no more(died in 1994) but the gifted property and owner of my brother are available.

Is there any possibilities on claiming my rights in the gifted property ?.

Pls clarify

You have absolute claim on the ancestral property. Better to consult a good lawuer who would guide you better and provide you necessary cervices.

Yes ! you can claim; discuss facts and history of property with a lawyer visiting his chamber.

yes your father can not gift any ancestral property to others., he having rights over his share alone.,

just speak with your family members for amicable settlements., there is no fruitful result mean just come back to legal formalities.,

same time limitation is important thing., you should be initiate this proceedings with in 3 years from the date of your major age.,

its ok., you can take an another ground of date of knowledge., you can manage it., just appoint an advocate.

File a suit for partition and seperate possession of your share. You will get it.
