Flat buyers society registration

Hi

We have bought the flat for which handover is not yet done. We all buyers are planning to form a registered society. Kindly advise if this is fine to form the society before getting the handover of the flats and the procedure for the same to get it registered in Faridabad, Haryana.

It would be nice if you recommond any lawyer who can help us in forming the Flat Buyers society..!!

Flat owner's society could be formed and registered with the Registrar of societies. Cooperative society could also be formed.It is the choice of the flat owners.

Yes and the same can be done even before physical possession of the same provided the sale is completed by a registered deed of purchase.

has registered sale deed been executed by builder ? has occupation certificate being obtained by builder .

if builder is not forming society flat owners can make application to Registrar Cooperative societies for formation of society

Thanks All for reply. In our case individual BB agreements were signed. OC is not yet obtained by builder. Our objective to form the Society is to -
1) Get unite and pressurize to the builder for possession which is already delayed by 3 years.
2) Since construction quality is poor and there would be lots of illegal demand during possession so to fight these kind of cases we plan to form the society.

Kindly advise if this society formation will help us achieving above objectives.

For delay in project, you need not form society. You can file consumer case straightway.

Without the registration of sale deed and occupation certificate it will not be possible to form a society or flat owners association. Your grievance is deficiency of service for which consumer forum is the right place to approach for relief and remedy.

Thanks all for your reply. Just put one point forward. I see that people have formed the association who have not got thw possession. One example is www.ferrouscityassociation.in.
They have been speaking in group with builder and able to push him for the pissession. Is it worth to have like this or builder will still not listen to it. Kindly guide if it is wise to have it and how ut can be done in faridabad.

we have advised you to contact Mr makkad in this regard . it is better flat owners get together to put pressure on builder
