False 498 complain

My son was married on year 2008. After a few months he saperated from me & moved to another place due to pressure of my daughter in law. My daughter in law naver came back to my house again.

On 2012 my daughter in law was saperated from my son.

On 2016 my daughter in law lodge 498 complain against my whole family while my wife was fighting with death. My wife was expired on 2016.

I have no relationship with my daughter in law from 2008 to 2016.

Police file Chargesheet against me & my wife.

Can I file any case against my daughter in law to teach her so that there type of torture will not be repeated against helpless any senior citizens ?

You have stated that your son and daughter-in-law separated in 2012, is it from court divorce? You consult a local lawyer with evidence.

Hello,

The case is already registered and FIR is already filed so you have to fight out the case and get acquittal. Later on you can file defamation case against your daughter in law.

Your priority ought to be meeting the charges of the present case of merits. You may take action to get the charges quashed or get acquitted on trial.

In case police have submitted CS, that means police have done the investigation and found ingredients for punishment. Get it mutually settled or defend yourself by DW. Alternatively you can counter complaint too. Please consider taking personal advice.

Your son and daghter in law had been residing separately from you since their marriage ( 2008 )and complaint was filed after 8 years of marriage in year 2016 so summarily no case is made out agsinst you . contest the case on merits and get acuitted thereafter may file case for malicious of prosecution.
