maintenance

(Querist) 22 March 2010 This query is : Resolved 
my friend filed a maintenance petition petitioner actually residing in one place filed a petition in another place. filing place is her brother residing due to some problems with her husband she went there at that time she filed a petition.at the time of filing the petition she submit a ration card of her brother but her name is not exist.now she is not residing her brother house. in cross examination she told that point respondent advocate arguing it is not her jurisdiction dismiss the petition. before this, interim maintenace also sanctioned her and her daughter.the petition next hearing is further evidence. now my question is how she can proove she residing there at that time. what evidence she have to produce

She may prove the residence by producing any document or by producing any witness who may depose orally about the place of residence of the petitioner.

She can place two modes of evidences.

i) she can produce any letter received in her name or any other correspondence. if her daughter is a school going girl, then also can prove the address given in school

ii) by proving the same through oral evidence. any neighbour can be a witness to depose her stay in her brother's home
