मैंने एक दीवानी का मुक़दमा किया था उस दावे में लिखे कुछ तथ्य मेरे प्रतिकूल है और अभी उस दावे का न्यायलय में मेरा बयान नहीं हुआ है क्या मैं तरमीम देकर उसे सुधार सकता हु और अभी उस मुकदमे में विपक्ष हाजिर नहीं हुआ है| मैं निम्न बिंदुओं पर आपका सुझाव चाहता हु कृपया उचित सुझाव प्रदान करे|
1 क्या तरमीम देने के बाद भी विपक्ष मेरे मूल तथ्य को आधार बना सकता है|
2 क्या तरमीम देना सही रहेगा अथवा दवा वापस ले लेना|
3 आप अपना अमूल्य सुझाव दे की मैं कैसे उस प्रतिकूल तथ्य से मुक्ति पा सकता हूँ

Dear querist,

You can file amendment application for making necessary correction in the suit. Defendant will get chance to oppose the application. You have to contest the suit cleverly.

Sir if defendant is not present in suit then who will oppose and what will be? and if my amendment application has been accepted by court then what can be do defendant?

You can submit application with necessary amendments in the plaint.

क्योंकि अभी तो प्रतिवादी को नोटिस जारी ही नहीं हुआ है तो आपको देखना है कि यदि मुकद्दम पुन: दायर करने की अनुमति लेकर वापिस लिया जाता है तो क्या वह काल-बाधित तो नहीं हो जाएगा। यदि काल बाधित होता हो तो इसी वाद मे संशोधन का प्रार्थना-पत्र लाना ठीक रहेगा अन्यथा आपको तकनीकी गलती का आधार बनाकर पुन: वाद को दायर करने की अनुमति के साथ वापिस लेकर फिर से दायर करना चाहिए।

You can also withdraw it with request to refile it after removing technical defects. Discuss with your lawyer who is well aware of all the facts and full case file. .
