Other resident uses my parking spot that i pay for

A resident in my building uses my parking spot that I pay for as maintenance charges and tells the security guards that he pays me to use the spot. He's never done so nor asked if he could use it. I don't have a car so I don't use the spot but he has 2 cars so he parks one in my spot and he's never asked for permission, doesn't pay me anything and lied to the guards about talking to me about it. I've sent a complaint to the maintenance office but I want to know if I there is legal grounds to ask for payment for the 1 year he's been using that spot. There's no evidence that he's used it from that time but that's what the guards have been saying. They also said he used to use another spot before but found mine to be more convenient.

file a case of unauthorised occupation or keep calling police every time he parks car there.

1. Take a few photographs of his vehicle parked in your allotted parking slot. Take audio recordings or written statement of Guard on this fact. See your service bills for parking charges and parking allotment letter.

2. Serve a legal notice to such member and the society, for trespassing on your parking space. Negotiate, create a leverage and THEN financially settle amicably by oral talks.

3. On failure, file police FIR on member & society for trespassing & intimidation & breach of trust and follow forward ....

Are you not residing in the complex?
The security guard's statements are not a confirmation.
If you have found it yourself, then you may ask the intruder to vacate the car parking space allotted to you.
You cannot legally demand the rent for the use of your parking space by that person, it would be an illegal act.
