Mutation entry

Respected sir,my name is Nikhil sonawane my mother purchased a agreeculture land in 2014....by sale deed.we get the possession but mutation entry was not made hence we applied for mutation entry in 2017 but our application was rejected and the error was noc of land aquision officer needed?my quetion is only that in what circumstances does non objection certificate of land aquision officer is needed....

Possibly a notification for acquiring the land has been issued by the Govt.in which case your purchase will be subject to the notification. Hence please verify with the Tahasildar's office whether any notification for acquisition has been issued. If it is correct, the owner of the land who sold the property to your mother without revealing the fact, is guilty of cheating and you may have to take legal action against him.

NOC was required to be obtained before registration of sale/ purchase transaction, did you get?

Dear Vashistaji. The query is for mutation in revenue records. As per the query the sale deed was already registered and when they approached the authorities for mutation they are required to produce the NOC from land acquisition officer. Hence I suggested that they should ascertain from the Tahasildar's office if the land is subject to any LA notification. If there is no LA notification then the need for NOC from the LAO does not arise.

I FULLY AGREE WITH MR. GUPTATHERE MAY BE ANOTHER POSSIBILITY THAT THE VILLAGE MIGHT NOT BE UNDER LIQUIDATION AT THE TIME OF SALE DEED BUT MAY BE UNDER LIQUIDATION NOW. IN THAT CASE MUTATION WILL BE DONE BY LIQUIDATION OFFICER.

Dear Rajivji. Thanks for agreeing with my views. You have used the words "village" and "liquidation". I assume what you meant is "land" and "acquisition" respectively. Pl confirm.
