(Querist) 27 August 2018 This query is : Resolved
3 decades ago, Govt has occupied my property and built bus shelter and community hall. No compensation was given neither was our consent asked. We lived in another city at that time. Can i reclaim that property now?

Have you any proof for that property? How did you get that property? is it ancestral or self acquired? However why your keep quite for more than 30 years? Now why are you asking? You have not mentioned where the property is situated. brief all facts for proper reply.

It is ancestral property. The property is in the name of my deceased grand father in the old land records. I came to know about it only recently. The property is situated in orissa. A bus shelter was built in my property. Now the govt wants to extend the bus shelter by encroaching the remaining land i have around the already encroached property by demolishing the old bus shelter and building a new one

Show the title documents of the land to a local prudent lawyer for better appreciation of facts, analyse, guide and proceed.
However, you have slept over the issue for more than 3 decades, the issue of adverse possession shall be one of the major obstacle in your re-claim.

You can approach the High Court through a Writ petition or initiate civil actio after serving due notice under Section 80 CPC.
