Can a separated wife file RTI for husband 's income

I don't whether I will called as a separated wife, because me and my minor child were dropped by my husband at my matrimonial house nearly 11 months back and never took us back. On some days he comes and meets baby or takes him out for 2-3 hours. He doesn't talk to me or my parents. He had threatened in between for divorce but not yet sent any notice. nor he pays any thing for mine or baby 's expenses. So 5 months back, I started working. Can I file RTI for his income. He has recently started his business 7 months back. Am I or minor baby are eligible for maintenance even if a divorce is not occurred.

RTI is applicable only to government and its funded sectors, and not to private sector. You can send him notice for restitution of conjugal rights.

By sending a notice for restitution of conjugal right, will he be agitated for a divorce. I am not willing for divorce.

Prooving that he is well capable to provide maintenance to his child and wife, but still he is denying when asked by me.
