Unpaid maintenance for vacant flat

(Querist) 20 March 2016 This query is : Resolved
Hello experts,

Would like to know if there is any Supreme Court or Delhi High Court ruling which states that there is no need to pay society maintenance for vacant flat? I am not able to find such judgement so would appreciate any help from experts.

Sir,
Once the building is complete, O.C. is obtained possession is given, you have to pay maintenance whether the flat is occupied or lies vacant.
Good Luck,

society Maintenance is not for the internal maintenance of the flat, but it is for the common areas, facilities and amenities. Hence, the maintenance charges are applicable even if it is vacant or located in any state in India, unless it is specifically mentioned in the rule book of that particular society.
