I am liable to get 1/3 share or not

My father got a Landed property after division from property on name of my Grandmother (Purchased by Grandfather on name of Grandmother) equally divided in lifetime of Grandmother among her 2 sons.

Do I have any right in that property?

Can I seek my part from that Land?

Please guide.

My father has 2 son me and my elder brother and he is alive , he will not give anything or help me in my living. I am in trouble since 5 years but he doesn't help me and live with his elder son as he was also elder.

The property got by your father from his mother is deemed as "Self-acquired property" as per law. Your father is free to deal with such property as he wishes. You are not eligible to claim any share in such property.

You have no claim in the property till life time of your father. He is free to sale, mortgage, will, or gift it as per his wish.

Though your grandfather purchased the property, it was on your grandmother's name, so it was her own property which she partitioned equally between her two sons. Now both the sons are absolute owners of their respective share of properties. Therefore, your father has full rights to dispose his share of property in the manner he desires it so, he cannot be compelled to allot you a share in the property, nor you have any rights over the property.

1. No, you can not claim any share in the said property,

2. Your father is at liberty to legally do whatever he feels like with the property.
