A party has given power of attorney to her father for act, appear and application in mutual consent divorce proceedings behalf of party from foreign country to India. A petition for M.C.D. u/s. 13B of Hindu Marriage Act attached with POA has presented in family court by first party in person and power of attorney holder of second party. The power of attorney has not exhibited by family Court, but, it has just marked as “1” by family Court.
Que-1: What does the meaning of marked POA and exhibited POA?
Que-2.: Is marked power of attorney applicable in family court as per law?
Que-3.: If the court is not exhibited the power of attorney then it is count as unauthorized/ unauthentic Power of attorney?

1. What was the exact words in the judgment.
2. It is allowed.
3. Non-exhibiting does not mean that the PoA is not valid.
