What remedy is available if the police didnot regsiter fir / atr?

I have file the Complaint before magistrate for commission of cognizable offence u/s 156(3) of CrPC which was send to SHO and give 40 days time to file ATR
I have been called at P.S where i have to wait several hours and nothing was done in the name of investigation nor the file has been filed..It appears police appaers to be reluctant in investigation
If after 40 days police in Action taken report (ATR) says nothing has come out in investigation, What remedy are available to me for invoking proper action?

You can file protest petition. Court may order for reinvestigation or may treat it as private complaint in place of state case.

You can move an application under section 173 (8) of criminal procedure code before the trial magistrate to ensure impartial enquiry/investigation of the case through another police official.
