Application of pf act and esi act

Dear Sir,
Many people are working one Dealer who is dealing in Industrial Spares. The Company is doing turnover of 15 crores. The group company employed more than 50 people for the services, but there is no ESI and PF for all people. What Law says, this company is running from 1992.
Also the company office time is 9.30 AM to 9.00 PM, only 30 minutes lunch break.
There is no leave for any employees, even on government Bandth, the salary is deducted.For this where we have to lodge a complaint and what is the legal opinion from your side.

The company would have treated them as daily wagers or contract labourers to avoid benefits of PF, gratuity and ESI. Try to contact the employees'/Trade union to solve the problem. If the employment is not properly rewarding shift to another company who function properly. Or contact an expert practing lawyer of the locality who is appearing for employees/workers.

You may lodge complaint with the Regional provident Commissioner for PF grievances and the Labor Authorities for violation of the labor laws (working hours, leave, holidays etc). Better lodge a collective complaint to avoid vindictive action by the employer against you if the complaint is lodged only by you.
