(Querist) 14 September 2012 This query is : Resolved
Respected Sir,
My self a disabled person, My father had transfer 5 acre agri land on my name in 1981 by giving an application to Kamgar talathi, accordingly,he made fer-far, 7/12 abstract, 8(A) abstract(property card). from that date this property in my possession and I am cultivating and taking crops from it. I staying in Mumbai since 1983 for service and cultivating land through labour. My father passed away in 2002. My mother and two sister file suit against me and claiming that my above stated property is accentual property and demanded equal part in this property. Court has consider only 7/12 abstract and not 8 A and giving decision that name on 7/12 is not title of land, it is just revenue arrangement and not giving ownership.on that basis court also concluded that this ancestral property and order to give equal part to my brother and Mother and one part to Sister. my Questions is
* Other than 7/12 and 8 A abstract what are other document which shows title of agri land.
* whether the limitation and tenancy act is implicate here and restrict court design.
* Is there possible me to save the land.
* My father had transfer this land on my name when I was studying in collage, Being a handicapped he had made arrangement for my future earrings. But I am not getting his origional application from agricultural dept.

yes, you have possibility to save the land as you are in possession of the land from year 1981 and your father had died in year 2002 , you can take defence of the the doctrin of reliquishment and family partition and you have strong case you are in possession of land from year 1981 and also a title in 7/12.consult specialized property lawyer or feel free to call on 9459321520 for detailed help regarding this.
