Grand daughters right

(Querist) 17 June 2012 This query is : Resolved
Dear sir, Iam christian, female married in 1996. My father inherited my grandfather’s instate property. My father gave that property to my two brothers equally and registration was done in 2006 on their names directly. When my grandfather died in the year 1963, one of my brothers and I were not born. The registration and mutation was not done in my father’s name till today. Somebody said Indian succession act was not clear in this regard. Please let me know how to proceed to seek justice if there is a chance on any grounds to claim granddaughter's share while father being alive. My brothes are not willing to give the least to me. Please help me..... sujatha

If your father gave the property to your brothers, that is final.

You have no claim in the same.

As the fact stated by you are contrary. On one hand you say that, my father gave that property to my two brothers equally and registration done in 2006 on their names directly.
On the other hand, you stated, the registration and mutation was not done in my father's name till today.
Then how could your father passed this property to your brother?

sir, As per the muncipal records, the property is still on the grandfathers name.but got registered in registrars office in the year 1999.

Muncipal records is required to be updated by submitting death certificate of your grandfather by your father. Then your father name will be entered as a legal heir. Likewise legal heirs record will be updated. You are also legal heir of your father but your father already given this property to your both brothers. First you orally demand your share if they not agreed or avoids then go to civil court to get your entitle share.
