Ancesstor property

Sir,

My father is two brother. They have three house. 1+1 seperately divded and one commonlly divided between them on 100 Rs. Stemp paper.

My father's brother died 1st and then his wife died they have no child.

She is died after my uncal and she is residing with other family member. Spouse she is not will to other family member then what we can do.

At present after 15 days of her death there is noboday come for the property claim. Please suggest how we can identified the actual position of her property. In their poration at present locked.

When nobody claim the property what my father do ?

Dear R. K. Tiwari,

As per hindu succession act your father only legal heir, beacuse his brother and his wife were expired with out having any Class I heirs. In the obsence of Class I hiers that properties devolving only Class second hiers i.e., Your father.

Please get the heritance certificate, death certificates and genelaogical tree and then apply to secured your father in the records in respect of that properties.

I agree with Sri Desai

if the proeprty is not transfered by your uncle . after his death his wife not transferd , not executed any Will Deed , your father beign the immidiete succesor to his brother and it being the Your family ancestral proerty,the proerty devolves on your father . Your father is the owner by succession .

Other siblings become the owner of the property.
