Where civil suit will be filed?

Hi,

For dishonored cheques and recovery of money, would you file a civil suit under order 37 of CPC in Sessions Court or in Civil Court?

Will it be a summary procedure or regular trial?

if going for dishonour of cheque it is criminal proceeding which should move in criminal courts and for recovery of money it should move in civil court only. a summary suit for recovery of money

summary suit will also be converted into a regular suit if the defendant obtains leave before the court.

it should be regular civil suit., according to the case amount the pecuniary jurisdiction will be decided..
