We have a booth in Punjab, rented out since 4 years. Originally the rent was fixed at Rs17000/- but since the market area was new, I allowed the tenant a rebate of 50%. Now the market area has developed & the rents have also increased. the tenancy agreement expired on Oct31,2011. the tenant refuses to pay an increased rent & is even not vacating the possession, has not even paid the rent for this month. what legal action can be taken for a fast solution? would I be entitled to the original Rs17000/- rent (without rebate) during the course of litigation?

The default in making the payment of rent is a ground for eviction. So you can proceed to file such case when the tenant would be having no option but to pay the rent.
In the alternative you may file case for determination of fair rent as per the current market rate.

engage a local lawyer .issue the tenant legal notice for eviction as agreement has expired . however please note that judicial process takes time
