Esi applicable for pf members also?

Dear Forum,

Despite holding PF Benefits,
ESI benefits applicable for corporate employees having taxable income?

clarify my Que thru ur answers

what is your query. are you asking whether ESI benefits are applicable for Corporate Employees or something else. please put your queries clearly.

There is no question of taxable or non-taxable income in the case of ESI.

ESI is applicable to regular employees (workers) up to wages of 15,000 p.m. (w.e.f. 01.05.2010) irrespective of whether that falls within the scope of taxable income or not.

@ all,
i recently resigned my company and joined a new company.

when i asked about ESI to my previous company they told i am not eligible.
hence this post.

My pay details for Mar 2011:
Earnings:-
Basic:11270
HRA:3000
Spl All:9209

deductions:-
PF:1352
Tax:500

Net:21627

Still i am eleigble for ESI as per
2010 April - 2011 Mar Financial year

Your company has correctly advised, as you are not eligible for the ESI, as per the definition of wages under sec. 2(22) of the ESIC Act, which explains as follows:

" wages" means ALL REMUNERATION paid or payable, in cash to an employee, if the terms of the contract of employment, express or implied, were fulfilled and includes any payment to an employee in respect of any period of authorised leave, lock- out, strike which is not illegal or lay- off and other additional remuneration, if any.

So, the total of your basic pay, HRA and special allowance exceeds the limit of Rs. 15,000.
