true interpretation of judgement and order

(Querist) 28 March 2009 This query is : Resolved
The consumer disputes redressal forum directed the "opposite party to refund to the complainant a sum of Rs. x against down payment of Rs. y amount on account of deficiency in service on their part".
In an appeal the State Consumer Disputes redressal commission "allowed the appeal of the complainant by awarding a compensation of Rs. T as compensation which shall also include the cost of litigation."
My simple query, Is x amount separate from t amount ? or t amount includes x amount ? Does compensation include the refund also ?

you have to follow the judgment of the state commission, and you cannot execute the district consumer redressal forums judgment.

In my opinion, he has to pay t amount and the cost of litigation only.(in your word, t amount includes x amount also).

T amount is final. It has nothing to do with the amount awarded by the District Forum. T and cost of litigation is the only payable amount.

I agree with Mr. Palnitkar.

Rs T amount is different and includes Rs X, which is awarded by district forum. Rs T and cost of litigation is pnly payable amount.
