RETAIRED PERSON WANTS RETAIN

(Querist) 26 July 2011 This query is : Resolved 
Dear Experts,

One of our employee is retaired from services as per the standing orders. But all the concern HODs wants to retain him for further service. In that juncture as an HR head what I have to do. We can not put him on muster rolls of the company.

WHAT I HAVE TO DO ? PLEASE ADVISE ME.

1)please note that generally on an employee having reached retirement age company cannot continue keeping him in full employment .
2)when the company appointed him as an employee it must have mentioned his retirement age . if the appointment letter mentioned that retirement age can be extended by mutual consent you can extend retirement age
3) in my opinion it is advisable to keep him as an consultant . appoint him as an consultant on yearly basis

Another option,You can retain him on contract basis after retirement.

you may retain him on contractual basis,so that a precedence is not created by extending his service against the service rules if any of your organisation.

YOU HAVE NOT INDICATED THE TYPE OF POST THE EMPLOYEE HELD BEFORE SUCH RETIREMENT, SERVICE RULE/ CONDITION OF YOUR ORGANISATION AND INDISPENSABILITY OF SUCH PERSON IN THE OPINION OF SUPERIOR OFFICERS BEFORE SEEKING REPLY ON THE MATTER.
