Non receipt of due payment from client

Dear Sir,

we are a placement firm located in Delhi and has entered into an agreement with a company for providing them manpower. 30 candidates have been sent for interview, out of which only two have been selected and have joined them. Professional fee of one candidate has been received, but the client is not releasing the professional fee for the second candidate. As per the MoU signed between us, he professional fee has to be paid within 10 days of candidate's joining. Every time lame excuses and reasons have been given by them, but not to our satisfaction.

kindly suggest what to do?

Send a Legal Notice to the company for payment. if the company not paid, go to the civil court.

From your post, it appears that though the payment is being received from your client, it is not coming within time and there is delay.
But, once you know the kind of client, then it is for you to adjust and go rather than sticking to the point of timely payment etc. After all, there is only delay in payment and not denying to pay.
It happens in business - the payments do take time.
If you are interested in long term relationship then you should not mind the delay. Otherwise, if you are well established in your business and do not mind losing this client, then you can take legal action.
In your place, I would maintain the business relationship and would not mind some delay in receiving the payment, so long as I am getting business from the said client.

Dear Ramachandran Sir,

greetings. At one instance you are very right. but, the case is that they are having ill intentions to just collect the resumes and then they want to use them as open candidates. In one case, a female computer operator, has been interviewed 6 times prior to her last meeting by the business head. its not a big company, it only has 5 persons and all of them are working as Head of Depts. total 14 persons are working in this company. in anogther instance, a psychologist has been sent for interview, to which the interviewer has selected her and has asked her to come next day for HR Round. She visited that company at the communicated time and the HR Head has just looked to her face and has not discussed even a single issue and has told her that He will discuss the issues over the phone and that your HR round is over. Despite repeated calls to the HR Head by us and the candidate, she has not been informed the salary and other benefits. When we intervened again, then two days prior to her joining she has been sent the offer letter to join and nothing else has been communicated to her. thereafter, she has refues to join. it took 25 days to keepthe candidate open to join them and belatedly all our efforts have gone in the docks. now what to do?

The answer is very straight and simple. As I said earlier, if it is only the question of delayed payment, one has to wait and get the payment.

If the dealings are troublesome otherwise, then you have to act tough, there is no doubt.
