Is it mandatory to publish in a newspaper a notice for sale of property?

There is no such legal requirement that an advertisement should be published in a newspaper before any property could be sold. However, if the property is involved in any court case or other legal tangle, and if there are any specific directions by the Court, then one has to abide by the Court direction and publish in the newspaper about the proposal to sell the property. Otherwise there is no such requirement.

If the property is sold by a bank or FI, under the SARFAESI Act, it is mandatory to publish the sale notice 30 days earlier to the date of sale, in two leading news papers, one in vernacular language. In case of sale of property by Debts Recovery Tribunal, publication of sale notice is compulsory.
