PG Accommodation

Querist : Anonymous (Querist) 07 October 2010 This query is : Resolved
I want to use my society flat in Gurgaon for PG accommodation (with several tenants in the same flat). I won't live in that flat but will provide a cook-cum-servant.
Society permission police verification will be taken care of but my queries below are on some other topics.

* Do (each of) the tenants in PG accommodation sign a normal lease deed (separate lease deed for each tenant) or there is some other way?

* Can a tenant stay in the PG accommodation as long as he wants? or he can be evicted at any time? In case of normal tenancy, tenant can't be evicted easily (sometimes not at all) because the law is in the favour of the tenant.

I am thinking of going on the PG route because, as wrote above, normal tenants can't be evicted. But, is PG same in this regard?

Strictly and legally speaking. Paying Guest accommodation does not create a lease or tenancy. It is merely a license.

But SS Sir, does licence fall under the ambit of Indian Contract Act as PG accommodation satisfies all the conditions of a valid contract. Please correct me if I am wrong.

Yes , PG accommodation does not create any tenancy or lease. However if you insist to enter into any agreement then go for leave and license agreement.

If PG accommodation does not create any tenancy or lease, then what is the procedure to evict the tenant?

Thanks.
