APPOINTMENT OF A RECEIVER.

DEAR SIR,

I HAVE MOVED AN APPLICATION IN THE DELHI HIGH COURT SEEKING APPOINTMENT OF A RECEIVER FOR THE GUEST HOUSE BEING ILLEGALLY RUN BUY MY BROTHER UNAUTHORISEDLY ON MY PROPERTY.

THE EVIDENCES ARE OVERWHELMINGLY IN MY FAVOUR AND A RECEIVER IS LIKELY TO BE APPOINTED.

MY QUERY IS

SINCE I HAVE REQUESTED FOR A RECEIVER IT IS I WHO WILL HAVE TO PAY SOME FEES?

IF SO ANY IDEA WHAT THE FEES WILL COST ME AND IF THERE IS A CERTAIN SCHEDULE OF RATES.

THE MATTER IS WITH DELHI HIGH COURT .

You only have to bear it. There is no fixed schedule for the same. The court will fix his fees.

U certainly will have to pay at the first instance. However,if the RECEIVER continues in office, U may apply to court,at a later stage,to pay 50% of the fees as U may argue that a RECEIVER is appointed by the court for the benefit of both.
Remember, payments made to the RECEIVER may be recovered by the successful party from the unsuccessful party if the court awards costs.

Yes.. Mr.subramanian stated exactly.. The court only can fix his fees..

it is at the discretion of court based on the value of the building
