First summon not received

(Querist) 16 October 2015 This query is : Resolved 
my wife has filed false complaint on me and my mother under IPC 498a and 325, and the police has left us u/s 41 (1)A and now the case has forwarded to court and the court is about to issue us the first summon in few days but we are not mentaly prepared, so please tell me can we avoid this summon or not? if can so please tell what will the futher action by court

What is there to fear about summons for 498a/ 325.

You would have to contest the case today/ tomorrow/ day after. There is no way you can avoid it till eternity.

In any case, after chargesheet on the first date of hearing you would be provided with a copy of the chargesheet, which you have to study and get back at a later date.

After serving the summons, trial takes place step by step; the final verdict takes months, if not years.

On the appointed day, the accused need only be present, take out the bail and receive the copy of the charge.

There is nothing to worry about this, if you are not able to attend the court on first appearance, you may ask your lawyer to represent you in the court.
do not stay back without any reason after receiving the summons because a NBW may be issued by court.
