(Querist) 19 May 2015 This query is : Resolved
SIR
THE UNDERSIGNED WHO IS WORKING UNDER CENTRAL GOVERNMENT,WAS COMMUNICATED ADVERSE APAR FOR 2013-14 ON 30-9-2014. THE UNDERSIGNED HAS REPRESENTED AGAINST IT ON 12-10-2014 .TILL NOW NO REPLY HAS BEEN RECEIVED FROM THE DEPARTMENT.
KINDLY LET ME KNOW WHAT IS THE LAST DATE TILL WHICH I CAN APPROACH CAT. MY REASON FOR ASKING THIS IS, ACTUALLY I WANT TO DELAY THE CASE AS LONG AS POSSIBLE.
KIND REGARDS

First send a very polite and gentle reminder to the authority to whom you originally represented, stating that you have not heard anything after submitting the representation.

Send reminder to the reviewing / authority to whom you have represented.
Kumar Doab (Expert) 19 May 2015
Whatever you may submit do so under proper acknowledgment..................be it even a reminder.

The procedure is explained in Dept. Rules.

From your side you can't do anything to delay.

Even if you intend to delay don't forget to submit requisite representations as narrated in rules.............of course under proper acknowledgment.
Sudhir Kumar, Advocate (Expert) 20 May 2015
Normally cause of action startes from 6 months of the representation (if not replied) and from the date of receipt of reply (if replied).

In case of representation against ACR the same has to be disposed off within one month. when one has passed after your representation then cause of action starts and limitation of one year starts.
