Refusal by ddo to sign bank loan document of sbi

Sir,
I am a regular employee of department of Post. Recently, some of our staff applied for SBI personal loan. But our Postmaster being the DDO refuse to sign the loan from and directed to take prior permission from the D & A authority. And the matter is stuck between. Kindly, enlighten whether any prior permission is required from the Appointing authority to take a personal loan from Bank from which our monthly salary is being drawn and the means to avail the loan.

Before asking whether prior permission from the Appointing Authority is to be obtained, you have to first state under what provisions the Post Master is obliged to sign the Loan Form?

Your Postmaster is right in his objection, as borriwing from bank without prior permission of the competent authority is prohibited for Government employees under the provisions of Rule 16 of the CCS (Conduct) Rules.

Thank you all so much for the reply and clarification in this regard. The staff have submitted for seeking approval from the competent Authority but the no approval has been granted and the matter is being kept unattended. Kindly direct us further steps that can be taken from the staff side in this matter.

Not possible without formal permission of the competent authority under the CCS (Conduct) Rules. If the postmaster signs loan form without due permission of the competent authority to each individual official, his action can also be termed as misconduct on his part, as by signing the loan form, his action would lead to the unauthorised permission by misusung the authority of the competent authority.

If you did not have any official dealing with the lender then no prior permission is needed and only intimation is required to be given within one month of completion of tnasacntion and if such intimation not replied within three months is deemed accepted.
