Agreement to sell

(Querist) 18 March 2013 This query is : Resolved
DEAR SIRS/EXPERTS

THE TIME LIMIT TO FILE LITIGATION IS 3 YEARS.MY QUESTION IS THAT IF AGREEMENT SPECIFICALLY MENTIONED THE DATE OF CANCELLATION OF AGREEMENT, THEN WHAT IS THE DATE TO CALCULATE THE 3 YEARS ?
IS IT THE DATE ON WHICH AGREEMENT STANDS CANCELS? OR THE DATE ON WHICH THE NOTICE IS ISSUED BY CONTRACTING PARTY AFTER THE DATE ON WHICH AGREEMENT STANDS CANCELED ?

no more to add.

Generally so.
But if the conduct of the parties did not mean cancellation till sending of notice then the date can be calculated from date of notice also.

When a matter is about calculating any limitation for a suit one must count it from a safer cut of date instead of extending it by any analogy which courts may or may not agree.
Raj Kumar Makkad (Expert) 18 March 2013
Limitation shall be counted from the last day of cancellation of the agreement in the given query.
