Matrimony - mutual consent divorce

Guest (Querist) 08 October 2011 This query is : Resolved
Hi , I and my partner have filed for divorce under mutual consent. What if the other party does not turn up on the second/final date?
R.Ramachandran (Expert) 08 October 2011
Nothing. The court may give one more date. If then also the other party does not come, then the Mutual Consent Petition will not materialise.
Shonee Kapoor (Expert) 08 October 2011
The Divorce won't happen, if the other party doesnot turn up on dates for second motion and further till 18 months of 1st motion.

Divorce on mutual consent shall not be granted in that condition.
Advocate M.Bhadra (Expert) 08 October 2011
Non appearance of any party petition for divorce on mutual consent would be dismissed by default, then you may file a divorce suit by your side on contest.

Mutual and consent, the two words themselves speak about the result of absence of one party.Neither shall remain there mutuality nor the consent as both require existence plurality.so even you did not know the law ,always use your ordinary prudence then seek if your analysis is not as an exception in law to ascertain what you thought so is correct or incorrect.

all are correct.
