This query is : Resolved
i have purchased a flat in the society named as Prateek the Royal cliff. after registration of the sale deed and the getting the possession of the flat. Out of 190 flats in the society at present 50 families are living in the building. Even the bank approved the loan. Now after possession of the flat, we came to knew that the builder do not have completion certificate and NOC from GDA, fire department (lifts are small in size though having floor upto 17) and its building is not been approved by GDA through RTI application filed in GDA. Though we keep asking the builder(verbally and some person asked through mails) to provide the documents, every time he gave false promise to provide the same( builder never gave reply of mails). kindly help us in this matter and also tell the legal remedy for the same, at the same time we do not want our builder should be sealed by GDA.

Inform the matter to the Housing Department,Govt of Delhi and also GDA.Send a legal notice to the builder/developer calling them to extend service as per terms,if the said builder would not comply then file a case in Consumer Forum for deficiency of serice, mental agony, damages etc.

Dear All,
First of all thank u for such prompt response.
i came to knew that if i make any complaint against the builder, there is threat of sealing the whole building and therefore people in the society are scared to take any action. Further i want to know whether as per law there is any provision, which describe the minimum area of the lift. i have gone through the UP apartment act 2010, but i do not found anything in it.

Dear Anjali,
There is no use of asking for the advice of the experts, if the people of the society are scared to take any action, as suggested by the experts.
