Dear Lawyer, I have married a divorcee one year back. I want to apply for a fresh passport to my wife and son. My son age is 5 years. I am not the biological father of my son. In my son passport father name should be mine. Please suggest me what are the legal documents need to submit to the passport authority.

Without the consent of the biological father it is difficult to apply for passport. You may produce the divorce decree so the signature of the biological father of the child may be avoided.

apart from that just get a legal adoption from the natural guardian of the minor boy. mean her mother can give adoption to you.
your age is also relevant factor for the same.

Approach the passport authority in your city.. they will certainly help you in this regard.

is the boy son of your ( ex divorcee) wife Does she have encumberanceless custody f the child as may have been specified in the divorce decree, then your status shall be of a step father, Alternatively the boy can also have an independent minor's passport.

Agree with the expert Devajyoti Barman.
Try to adopt the child. Then your name can be exhibited against the father's column, since Bombay High Court ruled that Adoptive father's name can be shown in the passport application.
