Recovery of notice pay

(Querist) 20 February 2015 This query is : Resolved 
Employer does not pay notice pay as required in the appointment order. Reconciliation efforts did not bring in any result. Now to proceed in the Labour Court which Act and Section one has to follow. Kindly also suggest a local lawyer in Marol, Andheri (E), Mumbai 400059.

You lodge a complaint with the labour commissioner stating your problem. You need not mention any section. In a proceeding before the labour commissioner , you do not need a lawyer.
If the dispute reaches the labour court then only engage an advocate.
Remember, if you do not engage an advocate, the employer can not also engage an advocate.

You have been advised in detail in many threads initiated by you.

If employer has violated the provision of Labor Laws it can be penalized.

It shall be appropriate to consult employee's/trade unions leaders e.g. CITU/INTUC/AITUC/BMS............before you proceed further.....
