Consumer protection act

(Querist) 06 July 2014 This query is : Resolved 
A filed a complaint against my client bank for cheating of 4 lac Rs. by way of forged cheque. Police investigation is pending. meanwhile A filed a case under consumer protection act for Rs. 4 lac and mental agony. My question is, when police investigation is pending, consumer protection act is applicable ? If possible give any citation in this regards.
