wife has been tortured mentally and physically for dowry. she is in depression state now. consulting some saying proofs are required how to prove that in-laws used to slap and beat her because for jst slapping and beating she was never taken to hospital. even when her sister in-law try to cut her wrist with knife she saved although cut was there but she was given medical aid at home only ,still there is mark left of cut on wrist but no medical slip. husband, sister in-law, mother in-law, brother in-law tried to kill wife by gripping her neck tightly but luckily saved as phone call comes and she shouted but that was her uncle call whom after knowing come and warned them but they apologized at that time. but after few days again there behavior same. now wife has been thrown out of home they tried to reconcile but they said money or divorce. wife is from poor family and don't want divorce jst 1 year of marriage??also in the 100m area of in-laws house there is no other house as in-laws house is in the lonely area so no witness.so no neighbors witness how to prove torture by in-laws??????please advise

Without corroborative evidence the torture is hard to be proved in court.

Even if no neighbour is witness, the statement of the wife and her family members shall be sufficient. Generally neighbour do not come forward for their evidence.

I think courts do take notice of facts that in matrimonial causes it would be only people in family and relatives who would witness things first and not the strangers, then theory of "interested witness"should be overlooked when a matrimonial court is examining a fact of assault by one spouse on the other in night in the bed room or in noon by mother/sister-in law when none other were present in the house.Single testimony should, if not found manipulative,be sufficient to prove the fact.

IN PAST YOU CLAIMED
"actually situation is that there was guy whom she chat online for 1 year as a friend, during this period that guy started liking her and soon the guy proposed her she said no and disconnected from him.after this she got married although she informed about this whole incident to her husband ""
NOW YOU CLAIM "wife has been tortured mentally and physically for dowry."
WHAT IS THE REAL CAUSE OF MATRIMONIAL DISPUTE, AND STRAINED RELATIONSHIP??
Try to clarify with your husband and in laws , and adopt the method of forgive and forget.
Humans make mistake.
If u charge Dowry, u r otherwise also breaking Marriage.
Instead, confess and see, if situation improves, or separate under 13B. peacefully.

Had I noticed it I would have refrained from replying.

yes sir very true i asked for that in earlier query, actually she was tortured for dowry from the day of marriage because in-laws want to buy some property in delhi but wife thought with passage of time it will be ok. But after 1 years torture when they get to know that wife parents can't give more money so they are asking for divorce and when wife approached women cell then husband is showing those chats to blackmail her to take case back and give him divorce as maybe husband consult some lawyer whom saying that without valid reason husband will not get divorce so he is making that chats as ground so in earlier post asked about that because husband don't want to come to women cell and want fast divorce so that as his mother is saying he wants to remarry his son. but now situation is that husband don't want reconciliation so wife as advised by all decided to put case there again lawyers asking for proofs. as her sister in-law tries to cut his wrist but saved although cut mark is still there but lawyer is asking for medical slip. wife never thought of situation to come to this point i.e. she never try to collect the evidence so asking for this although this is true that she was tortured to the hell..

One has no moral right to dictate others not to address query of an author whose account has been deleted but the same expert is thoroughly and repeatedly addressing the same query/

The answer was written before appeal and clearly reads"i do not remember by time i answered he was deleted or not as idea of refusal just flicked in my mind."
MOREOVER IT WAS SIMPLY APPEAL.NOT A MANDATE.
NOR DO I HAVE ANY RIGHT TO ISSUE MANDATES.
BUT IT IS MORE THAN ENOUGH TO COMMENT WHAT IS MORAL AND WHAT IS IMMORAL AS THAT CAN BE TESTED ONLY IN PERSONAL COMPANY OF A HUMAN NOT ON A BASIS OF ANY APPEAL OF THE KIND I MADE HERE.
